Bringing a child under 18 to the UK to live with a parent — including sole responsibility applications, dependant child visas, and complex parenting situations.

Quick Overview

UK Child Visa — Key Facts

The UK Child visa allows children under 18 to join or remain with a parent or parents in the UK. Requirements differ depending on whether the parent is a British citizen, settled person, or on a temporary visa.

  • Under 18 Only: The Child visa is for dependent children under 18 years of age.
  • Both Parents Must Be Settled: Generally, both parents must be settled in the UK — or sole responsibility must be demonstrated where one parent is not settled.
  • Sole Responsibility: Establishing sole responsibility is legally complex and requires careful evidence — we advise on this in detail.
  • Dependant Children: Children under 18 may also join as dependants on most long-term work visas, including Skilled Worker and Global Talent.
  • State Schools: Dependant children can attend UK state schools and access NHS healthcare.

What Is the UK Child Visa?

The UK Child visa is the immigration route for children under 18 who wish to join or remain with a parent or parents in the United Kingdom. It is governed by Appendix FM of the Immigration Rules. Requirements differ depending on whether the child is joining a parent who is a British citizen, a settled person, or a person on a temporary visa.

Who Can Apply Under Appendix FM?

Under Appendix FM, a child may apply to join or remain with a parent in the UK where that parent is a British citizen, holds ILR, or holds refugee or humanitarian protection status. Both parents must either be settled in the UK, or one parent must be settled and the other absent, without contact with the child, or there must be sole responsibility or other exceptional circumstances.

What Is 'Sole Responsibility'?

Where the child's UK-based parent does not have shared parental responsibility with the other parent abroad, the UK parent must demonstrate "sole responsibility" — that they have been primarily responsible for the child's upbringing, including important decisions about education, health, and welfare, even if the child has been living with the other parent abroad. Establishing sole responsibility is legally complex and requires careful legal advice and thorough documentary evidence.

Can a Child Join a Parent on a Work Visa as a Dependant?

Yes. Children under 18 may be included as dependants on most long-term work visa applications, including the Skilled Worker visa, Health and Care Worker visa, and Global Talent visa. Dependant children have the right to live in the UK, study — including at state schools — and access NHS healthcare. They cannot work until they turn 18 unless they obtain separate permission.

Complex Parenting Situations

Child visa applications can be emotionally sensitive and legally complex — particularly where parental situations are complicated, where questions of sole responsibility arise, or where a child has been cared for by an extended family member. Our solicitors approach every child visa matter with compassion and precision, ensuring the application presents the clearest possible case for the child to be granted leave.

UK Child Visa FAQ

What is sole responsibility and why does it matter?
Sole responsibility means the UK parent has been primarily responsible for the child's upbringing. It must be demonstrated where the other parent is abroad and shared parental responsibility cannot be evidenced.
Can my child join me on my work visa?
Yes. Children under 18 can be added as dependants to most long-term work visas — Skilled Worker, Health and Care Worker, Global Talent, and others.
Can dependant children attend state schools?
Yes. Children in the UK as dependants on most visa categories have the right to attend state schools and access NHS healthcare.
What if both parents are not settled?
Applications become more complex. We advise on the specific requirements and exceptional circumstances provisions in detail.
What documents are needed for a sole responsibility claim?
Evidence showing the UK parent has made key decisions about the child's education, health, and welfare — school records, medical records, communication history, and financial support evidence all play a role.
Can a grandparent or other relative apply for a child visa?
In limited circumstances, yes — under the exceptional circumstances provisions. This is a complex area requiring specialist advice.
What if the child turns 18 during the application process?
Age is assessed at the date of application, not at the date of decision. If the child was under 18 when the application was made, it can still proceed even if they turn 18 during processing.
Can the child apply for ILR after coming to the UK?
Yes, in time. Dependant children who have lived in the UK for a continuous period may become eligible to apply for ILR once the qualifying conditions are met.

Child Visa Under Appendix FM

For children joining a British citizen or settled parent. Both parents must generally be settled in the UK, or one parent must demonstrate sole responsibility for the child's upbringing.

Sole Responsibility

Where the child has been living abroad with the other parent, the UK parent must show they have been primarily responsible for key decisions about education, health, and welfare. This is legally complex and requires thorough evidence.

Children as Dependants on Work Visas

Children under 18 can be added as dependants to most long-term work visas — Skilled Worker, Health and Care Worker, and Global Talent. They can attend state schools and access NHS healthcare.

Complex Situations

Where parenting arrangements are complicated — sole responsibility claims, children cared for by relatives, or situations involving both parents on different visa types — specialist legal advice is essential before making any application.

Sole responsibility claims are one of the most complex elements of any child visa application. Getting the evidence wrong — or underestimating what the Home Office requires — can result in a refusal that is very difficult to overturn. We advise on this area in detail before any application is submitted.
